What Is a Florida Traffic Ticket?

Under the Florida statutes, a civil traffic infraction, or ticket, is a non-criminal charge. There are two basic types of traffic tickets: moving violations and non-moving violations.

What Is a Florida Moving Violation?

A “moving violation” occurs when the vehicle is in motion. Common examples of moving violations include speeding; running a red light or stop sign; careless driving; child-restraint violations; failing to maintain a single lane; and recently added texting while driving.

What Is a Florida Non-Moving Violation?

A “non-moving violation” occurs when the vehicle is not moving. Common examples include failure to wear your seat belt; not carrying your driver’s license, registration or insurance card; expired registration less than six months; or expired driver’s license less than six months.

What is the Florida Point System?

Under the Florida statutes, points are assigned when you receive tickets for moving violations. If you accrue too many points over a certain period of time, your driver’s license can be revoked or suspended. Examples Include:

  • Careless Driving (3 Points)
  • Child Restraint Violation (3 Points)
  • Leaving Scene of a Crash Without Giving Information More Than $50 Damage (6 Points)
  • Fail to Obey Traffic Control Signal (4 Points)
  • Failure to Yield (3 Points)
  • Reckless Driving (4 Points)
  • Speeding (3 Points)

I Received a Florida Traffic Ticket, What Happens Next?

If you have been issued a traffic citation for a civil infraction, you have 30 days from the date of issuance to make a decision. Failure to satisfy your citation by selecting one of the options within 30 days of the issue date will result in the suspension of your driver license and will require the payment of late fees.

Your options are:

  1. Pay the civil penalty, admit guilt, and accept the associated points
  2. If applicable, pay the ticket and avoid points by taking a driver improvement course
  3. Plead not guilty and request a court hearing.
